AIA Subrogation Waivers: Current Trends and Creative Solutions

This presentation will include a brief discussion of the historical origins of the AIA Subrogation Waiver, its underlying rationale, and its evolution over the last 50 years. The remainder of the presentation will cover the current state of the law, which is largely negative for subrogation recoveries. Additionally, the presentation will also explore some recent case law that allows the pursuit of a subrogation claim in the face of an AIA Subrogation Waiver.
