Timothy defends insurance companies against first-party property breach of contract lawsuits and declaratory judgment actions for insurance coverage. These lawsuits often involve claims of water, fire, storm, or sinkhole damage at residential or commercial properties. Many of these lawsuits are brought by contractors who claim to have acquired rights from the insured by way of an assignment of insurance benefits.
Timothy also defends insurance companies against extra-contractual claims. These are sometimes called "bad faith" claims. As part of his work, Timothy helps insurers analyze and respond to Civil Remedy Notices of Insurer Violation.
Additionally, Timothy has handled matters pertaining to insurance compliance and reporting, construction defects, workers compensation, and employment law. Timothy often counsels insurance companies on emerging legal issues, recent case law decisions, and best practices with regard to these and other matters.
Timothy is licensed to practice law in Florida. Also, he is admitted to the U.S. District Court for the Middle District of Florida and the U.S. District Court for the Southern District of Florida. Timothy has completed the International Association of Defense Counsel (IADC) trial academy.
Prior to joining Butler Pappas, Timothy served as Staff Attorney (judicial law clerk) for the Sixth Judicial Circuit Court of Florida.
Timothy earned a Bachelor of Arts from St. Norbert College in DePere, Wisconsin. He was inducted into the Pi Gamma Mu International Honor Society in Social Science. Timothy earned a Juris Doctorate magna cum laude from Hamline University School of Law in St. Paul, Minnesota. He served as Operations and Production Editor of Hamline Law Review and was a Regional Finalist at the ABA Negotiation Moot Court Competition. Timothy received the Dean's Scholarship and appeared on the Dean's Honor List. He received four CALI Awards for achieving the highest grade in the classes of Property, Torts, Insurance Law, and National Security Law. During law school, Timothy attended the University of Notre Dame's Summer Law Programme in London where he studied carriage of goods by sea and the law of the European Union. During his final semester of law school, Timothy served as Judicial Extern to U.S. District Court Judge Ann D. Montgomery in the District of Minnesota.
